Commissions Policy

CJ Lucus Artwork is operated as a sole trader business in Queensland, Australia.
This Commissions Policy outlines the terms that apply when you engage CJ Lucus Artwork to create a commissioned artwork.

By paying a deposit, you agree to these terms.


1. Scope of Work

A commissioned artwork is an original, hand-painted piece created specifically for you.

Before any work begins, we will agree in writing (usually via email) on:

  • Subject matter
  • Size and medium
  • Colour direction
  • Timeframe
  • Price
  • Any special requirements

This written agreement becomes the Proposal and forms the basis of our contract.


2. Deposit & Payment Terms

A 35% non-refundable deposit is required to secure your booking.

The deposit:

  • Confirms your commission
  • Secures your place in the schedule
  • Covers preparatory time, consultation, and planning

The remaining balance:

  • Must be paid in full before the artwork is shipped or collected
  • May be paid in instalments by agreement
  • Will be invoiced prior to completion

Accepted payment methods include card and electronic bank transfer.


3. Cancellations

You may cancel your commission within 14 days of paying the deposit.

If cancellation occurs within this 14-day period:

  • The deposit will be retained.
  • No further payments will be required.

If cancellation occurs after painting has commenced:

  • The deposit remains non-refundable.
  • Additional costs may apply depending on work completed.

Because commissioned artwork is custom-created, change-of-mind cancellations beyond this period are not eligible for refunds.

Nothing in this clause affects your rights under Australian Consumer Law.


4. Revisions & Adjustments

You will be invited to approve the composition before painting begins.

Minor adjustments may be requested during early stages where reasonable.

However:

  • Extensive revisions may incur additional fees.
  • Major conceptual changes after commencement may not be possible.
  • Requests that materially alter the agreed Proposal may require a new commission.

Clear communication early in the process ensures the best outcome.


5. Communication Responsibilities

You agree to:

  • Provide accurate reference images.
  • Confirm you have permission to use any copyrighted references.
  • Respond to progress approvals within reasonable timeframes.

CJ Lucus Artwork agrees to:

  • Communicate clearly.
  • Provide progress updates where appropriate.
  • Complete the work with professional care and artistic integrity.

6. Intellectual Property

Upon full payment:

  • You own the physical artwork.
  • You may display it privately or publicly.

However:

  • Copyright and intellectual property remain with CJ Lucus Artwork.
  • The artwork may not be reproduced, copied, scanned, or commercially exploited without written permission.
  • CJ Lucus Artwork reserves the right to produce limited edition prints unless otherwise agreed in writing.

CJ Lucus Artwork may display the artwork on social media, website, or portfolio unless you request confidentiality in writing prior to publication.


7. Shipping & Risk

Shipping costs are quoted separately and depend on:

  • Size
  • Location
  • Insurance requirements

Risk transfers to you once the artwork has been dispatched.

CJ Lucus Artwork is not responsible for:

  • Customs charges
  • Import taxes
  • Courier delays outside reasonable control

Insurance will be included where appropriate.


8. Damaged Artwork

If your artwork arrives damaged:

  • Notify CJ Lucus Artwork within 24 hours of delivery.
  • Provide photographic evidence.
  • Retain all original packaging.

Where damage is confirmed, CJ Lucus Artwork may:

  • Repair the artwork
  • Replace the artwork (where possible)
  • Provide a refund consistent with Australian Consumer Law

9. Inability to Complete

If CJ Lucus Artwork is unable to complete the commission due to serious illness, emergency, or unforeseen circumstances:

  • You will be notified promptly.
  • A refund of amounts paid (excluding work completed where applicable) will be arranged.

10. Governing Law

This agreement is governed by the laws of Queensland, Australia.

Nothing in this policy excludes rights available under the Australian Consumer Law.
